
In December 2023, NOM-037 on Teleworking, a regulation issued by the Ministry of Labor and Social Welfare, created to regulate the safety and health conditions of people who work in the home office, will enter into force.
This regulation will have an impact on companies and, therefore, on the office spaces they currently occupy. The instrument is mandatory for all companies in Mexico that have remote staff with more than 40% of their working hours outside the workplace and carry out their activities with the support of technologies.

Ignacio Arellano, director of the real estate services firm Newmark, affirmed that the new regulations will represent an expense for corporations that was not budgeted for.
The organization and employee will determine how the teleworking modality will be carried out. Employers will be able to recurrently visit the homes of their collaborators, make sure that these work spaces at home comply with the protection and health guidelines, which may be through photographic evidence, videos or physical visits.
In this context, the main trend within the office market is the existence of spaces that are not assigned. Organizations now have completely open spaces where there is access to natural light, greater collaboration areas to interact with other people.
To achieve the above, traditional meeting rooms are used, but also informal meeting spaces, where there can be collaboration with other coffee shop-type employees, hence the evolution of coworkings or collaborative spaces.

The global trend is to return to work spaces in a hybrid scheme that combines 60% of the time in the office and 40% in teleworking, the latter as the preferred modality.
However, at any time, companies have the power to send their employees back directly to the office if the spaces where they telework do not comply with the guidelines and regulations of NOM-037.
According to the firm's observations, most companies are in a hybrid model where you go to the office at least three days a week. In this scenario, 60% of working hours are met in person, so they are subject to the rule.
